How can I prepare a document handover when changing property lawyers?

Ask the outgoing and incoming lawyers to agree a handover index and identify outstanding work with your authorisation.

Arrange a controlled legal handover

Create an inventory of the matter, listing documents held, originals in custody, advice already given and work still outstanding. Include the current contract draft, correspondence, search results, payment evidence and any appointments or time-sensitive notices. Separate your understanding of progress from points the outgoing lawyer has confirmed.

Ask both lawyers how your authority for release should be recorded and which secure transfer channel they will use. Clarify outstanding fees and administrative arrangements without assuming that either payment or a request alone resolves access to every part of the file. The incoming lawyer should explain what they need to assess independently.

Agree who is responsible for live communications during the transition, including contact with the notary and other transaction participants. Obtain acknowledgement of the material received and a list of missing items. Changing advisers does not itself confirm that earlier advice remains applicable or that another professional has taken over every outstanding task.

Practical considerations

  • Inventory originals and outstanding work.
  • Confirm responsibility during the transition.
  • Obtain a receipt for the transferred file.
