Buying Property
How should I assess a property’s access before buying?
Inspect the approach in practical terms and have your lawyer verify the rights supporting it. A route that people currently use is not, by itself, proof of secure legal access.
Test the everyday journey
Follow the route you would actually take from the surrounding road to the entrance. Note steep sections, narrow turns, gates, surfacing, lighting and places where vehicles cannot pass comfortably. Consider deliveries, removals, emergency access and the needs of anyone with limited mobility.
Ask whether conditions change during heavy rain and who deals with debris, vegetation or surface repairs. If parking is separate, walk the full route with shopping or luggage in mind. Do not assume a convenient neighbouring track will remain available.
Verify the underlying arrangements
Ask your lawyer to establish how access is recorded and whether rights, restrictions or shared responsibilities affect the property. An engineer or surveyor may need to compare the physical route with relevant plans and boundary information.
Clarify responsibility for gates, retaining structures, lighting and upkeep, including any shared decision-making. If improvements seem necessary, obtain technical advice and have the legal position checked before assuming you can widen, surface or alter the route. Record unresolved access questions before negotiating a commitment.
Practical considerations
- Inspect the entire approach, not just the entrance.
- Consider wet-weather and delivery access.
- Verify rights independently of current use.
- Check who maintains shared sections.
